Molestation Suspect Faces Deportation

A 76-year-old Naperville man, Daniel G. Hernandez, faces a possible deportation after his trial on sexual molestation charges, regardless of the outcome in court (Sun-Times). He has been accused of sexually abusing one of his grandchildren last December.

Hernandez remains in DuPage County Jail on a $17,500 bond, although US Immigration and Customs Enforcement (ICE) agents issued a "no bond" hold on the defendant, which means he's to be held until ICE officials can work out a bond for his deportation proceedings.

Police say the pre-teenage victim was abused between Dec. 14 and 18 and that Hernandez allegedly videotaped the child abuse, which shows both the defendant and the victim. ICE spokeswoman Gail Montenegro said federal authorities believe Hernandez is eligible for deportation but provided few details:

Hernandez's country of origin was not known. It also could not be determined Friday whether he is in the U.S. illegally, is here on a visa or has a "green card."

Police were alerted when a 911 caller said he or she was in possession of the aforementioned videotape. Emergency radio reports indicated that at least two family members locked themselves in a bedroom of the apartment before police arrived.

Although police did not confirm nor deny the existence of the videotape, they did say that evidence was recovered. No other children have been victimized, according Naperville Police Cmdr. Mike Anders.

Hernandez is to appear in court on Feb. 22.
